These Terms and Conditions ("Terms") govern your use of cmnailssupply.com (the "Website") and any purchase from CM Nails & Beauty Supply ("we", "us", or "our"). By using the Website or placing an order, you agree to be bound by these Terms in full. If you do not agree, please do not use the Website or place an order.
1. Use of the Website
Your use of the Website is subject to these Terms and all applicable laws. You agree not to misuse the Website, attempt unauthorized access, or interfere with its operation. The Website is provided on an "as available" basis and we do not guarantee uninterrupted access. We are not responsible for the content or practices of third party websites linked from the Website.
2. Eligibility
If you use the Website for a business or organization, you confirm you have authority to bind it to these Terms.
3. Products
We supply professional nail products including nail polish, gel polish, acrylic powders, tools, accessories, nail care products, and skincare products. Availability may change without notice. We are a distributor and reseller and do not manufacture most of the products we sell. To the maximum extent permitted by law, we disclaim liability for manufacturer defects, improper application, misuse, allergic reactions, or adverse effects from using these products.
Product images and colour
Images, colours, packaging, and descriptions may vary slightly because of device settings, lighting, manufacturer packaging changes, or batch variation. We do not guarantee that colours on the Website match the physical product exactly. Colour variation is not a product defect.
Professional use products
Some products are designated professional use only and require appropriate training for safe and effective application. By purchasing them, you confirm you have the training, knowledge, and skill to use them properly. We are not responsible for adverse effects, injuries, or damages from misuse, improper application, or failure to follow product instructions.
Compatibility, equipment, and curing
You are solely responsible for checking that products you buy work with your own tools, lamps, equipment, and systems before you purchase. This includes UV and LED lamps, replacement bulbs, nail drills and bits, gel systems, and acrylic systems. Gel curing depends on lamp wattage, bulb condition, curing time, and compatibility, and we do not guarantee curing results with equipment the manufacturer does not specify. Our team is happy to share general product information before you buy.
4. Orders and Cancellations
After you place an order, you receive a confirmation email. This confirmation is not final acceptance of your order. We may accept, decline, or cancel any order at our discretion.
To cancel an order, email info@cmnailssupply.com as soon as possible. Cancellation is not guaranteed once processing has begun. An approved cancellation carries a cancellation fee of $4.50 minimum, up to 7% of the order value, which we deduct from your refund. Refunds return to your original payment method within 5 to 10 business days of approval. We may deny cancellation requests from customers who cancel excessively or abusively.
5. Pricing, Taxes, and Promotions
All prices are in Canadian dollars unless stated otherwise. We may change prices and correct pricing errors at any time. Applicable taxes, including HST where required, are calculated and shown at checkout. Promotional pricing is valid while supplies last. You can use one promo code per order, and codes cannot be combined.
6. Returns and Refunds
All sales are final. Because of the professional nature and hygiene requirements of our products, we do not accept returns or exchanges for change of mind. Please review product details carefully before you buy, and contact us with any questions first.
Wrong, damaged, or defective items
If you receive a wrong, damaged, or defective item, email info@cmnailssupply.com within 7 days of delivery with your order number, the item name, a description of the issue, and clear photos of the item and packaging. We review every claim case by case. Claims made after 7 days cannot be accepted.
Please do not return anything without our written approval. If your claim is approved, we choose to send a replacement, issue store credit, or refund your original payment method. Store credit is issued as a gift card with no expiry date and no dormancy fees, in line with Ontario's Consumer Protection Act. For full details, see our Returns and Warranty page.
7. Shipping and Delivery
We currently ship within Canada only. Orders are processed within 1 to 2 business days, and large orders with more than 36 individual products may take close to 2 business days. Delivery times shown are carrier estimates and are not guaranteed.
An order confirmed as delivered by the carrier to the address you provided is considered fulfilled. We are not responsible for packages lost or stolen after confirmed delivery, so please choose a secure delivery location. If a package appears lost before delivery confirmation, we will help start a carrier investigation where possible. If a package is returned to us because of a wrong address or because it went unclaimed, you may choose to reship at your cost or receive a refund minus the original shipping cost and the cancellation fee. 8. Product Performance Disclaimer
Performance varies with application technique, preparation, environment, equipment, and individual use. We do not guarantee identical results for every user. Results shown in images or promotional materials are not guaranteed outcomes.
9. Limitation of Liability
Products are provided "as is" and "as available". To the maximum extent permitted by law, we are not liable for allergic reactions or sensitivities, improper application, incompatibility with your equipment, misuse of professional products by untrained individuals, damage to any third party caused by your misuse, or indirect, incidental, or consequential damages of any kind.
Our total cumulative liability to any customer will not exceed the total amount that customer paid for the products in question within the previous 12 months. Nothing in these Terms limits any liability that cannot be excluded under applicable law, including Ontario's Consumer Protection Act.
10. Indemnification
You agree to indemnify, defend, and hold harmless CM Nails & Beauty Supply and its owners, employees, and agents from claims, damages, losses, liabilities, costs, and expenses, including reasonable legal fees, arising from your use or misuse of any product, your violation of these Terms, your infringement of third party rights, including harm to a third party through improper use of a product, or any false statement you make in connection with your purchase, including about your professional status.
11. Wholesale Accounts
Wholesale pricing may be available to licensed nail technicians, salons, retailers, distributors, and approved businesses. Eligibility is subject to review and approval, and we may request documentation such as a business licence or nail technician certificate.
Wholesale customers follow the same Terms and policies as retail customers, including the all sales final policy. Wholesale pricing cannot be transferred and is confidential. It must not be publicly disclosed, advertised, or shared without our written consent. Products bought at wholesale pricing may not be resold without our prior written authorization. We may suspend or end wholesale accounts at any time, including for policy violations or inactivity. 12. Privacy and Data
Your use of the Website is also governed by our Privacy Policy. We handle personal information in line with Canada's Personal Information Protection and Electronic Documents Act (PIPEDA) and applicable provincial privacy laws. We share customer information with trusted third parties only as described in that policy, and we do not sell or rent your personal information for marketing purposes.
13. Electronic Communication
By using the Website or contacting us electronically, you agree that our electronic communications satisfy any legal requirement that communications be in writing.
14. Intellectual Property
All content on the Website, including text, images, logos, product descriptions, and graphics, belongs to CM Nails & Beauty Supply or its licensors and is protected by copyright and other intellectual property laws. You may not copy, distribute, or use it commercially without permission.
15. Payment Disputes and Chargebacks
Please contact us before you start a payment dispute. Email info@cmnailssupply.com and we will work with you to resolve the issue quickly and fairly. By completing a purchase, you agree to our store policies, including our Returns and Warranty, Shipping, and these Terms. Chargebacks filed to bypass these policies may be formally disputed with the payment processor.
If a chargeback or payment dispute is filed, we may submit documentation to the payment processor, including order and payment records, shipping and tracking confirmation, delivery confirmation, IP address and transaction verification data, and our communication history with you. Filing a chargeback on a legitimate transaction may be treated as abuse of the dispute system, and we may dispute it, refuse future service, notify local authorities, and cancel pending orders. To protect customers and our business, orders may be subject to address verification, fraud screening, and manual review, and we may cancel or refund orders that fail these checks.
16. Dispute Resolution
If a dispute arises from these Terms or a purchase on cmnailssupply.com, we will first try to resolve it in good faith by email at info@cmnailssupply.com. If we cannot resolve it within 30 days, both parties agree to try mediation that is not binding before any legal action. Mediation takes place in Toronto, Ontario, unless we agree otherwise in writing. Either party may still seek urgent court relief where needed to prevent irreparable harm.
17. Force Majeure
We are not liable for delays or failure to perform caused by events beyond our reasonable control, including carrier delays, labour disputes, natural disasters, government actions, supply chain disruptions, pandemics, and system outages.
18. Governing Law
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there. Subject to the dispute resolution section above, the courts of Ontario have exclusive jurisdiction over disputes from purchases or use of the Website.
19. Changes to These Terms
We may update these Terms at any time. When we make material changes, we post a notice on the Website for at least 30 days. We may make minor changes, such as grammar or formatting corrections, without notice. Continuing to use the Website after changes are posted means you accept the updated Terms.
